Air turbulence is a common phenomenon in aviation. While it may sometimes be minor, in other cases it can be sudden and severe, causing injuries to passengers. Nevertheless, air carriers remain legally responsible for any harm suffered by passengers during a flight, whether physical or psychological.


1. Legal Basis for Airline Liability

International air carrier liability is governed by the Montreal Convention of 1999, ratified by most countries, which clearly states:

  • The carrier is liable for passenger injuries occurring on board the aircraft or during embarkation or disembarkation.
  • The passenger does not need to prove fault to claim compensation; it suffices to show that the injury occurred during the flight.
  • Liability extends to physical and psychological harm, medical costs, and loss of earnings.

  • Using weather and turbulence monitoring systems

  • Restricting passenger movement when necessary
  • Providing immediate first aid if an injury occurs

4. Liability for Physical and Psychological Harm

The Montreal Convention allows compensation for:

  • Direct physical injuries resulting from the incident
  • Psychological harm related to the injury or caused by the extraordinary event
  • Medical and rehabilitation expenses
  • Financial losses due to inability to work

In cases of gross negligence or failure to provide proper first aid, the airline’s liability may increase beyond standard compensation limits.


5. Airline Obligations After an Incident

If a passenger is injured, the airline must:

  • Act promptly and provide first aid
  • Document the incident with an in-flight medical report
  • Transfer the injured passenger to proper medical care upon landing
  • Cooperate with the passenger in any compensation claims

Failure to perform these duties may constitute a breach of the airline’s safety obligations.


6. Passenger Rights to Claim Compensation

Passengers and their companions are entitled to:

  • Submit a direct claim to the airline
  • Access the competent court under the Montreal Convention rules (e.g., passenger’s residence, carrier’s principal place of business, contract location, or destination)
  • Claim fair compensation for physical, psychological, and financial damages

Air carriers are legally liable for injuries caused by air turbulence if they occur during the flight. They are exempt from liability only if they can prove that all possible preventive measures were taken, which is often difficult.
